OPINION

BRYNER, Chief Judge.

In this case, we are asked to decide whether a retroactive extension of the statute of limitations in a criminal case violates the constitutional prohibition against ex post facto laws. We conclude that it does.

On May 17, 1985, Robert C. Creekpaum was indicted for one count of sexual assault in the first degree in violation of AS 11.41.410(a). The assault was alleged to have occurred more than five years previously...
