This action is brought under the Racketeer Influenced and Corrupt Organizations Act ("RICO"), 18 U.S.C. §§ 1961-1968, and state law claims, based on both pendent and diversity jurisdiction, of fraud, negligent misrepresentation, and breach of express and implied warranty.
