STATE v. DRURY

No. KA 86 1422.

506 So.2d 772 (1987)

STATE of Louisiana v. Steve DRURY.

Court of Appeal of Louisiana, First Circuit.

April 14, 1987.

Attorney(s) appearing for the Case

Gail Sheffield, Asst. Dist. Atty., Amite, for plaintiff-appellant State.

Frank M. Edwards, Hammond, for defendant-appellee.

Before LOTTINGER, SHORTESS and CARTER, JJ.

LOTTINGER, Judge.

In this appeal, the state seeks review of the trial court's ruling which granted defendant's motion to quash the prosecution of two misdemeanor charges.

Defendant, Steve Drury, was separately indicted for resisting arrest, La.R.S. 14:108, and simple assault, La.R.S. 14:38. The grand jury report also reflects that, on the same date, defendant was indicted for possession of a fur-bearing animal without a license, La.R.S. 56:103.
