Gilomen, Jr., ("Gilomen") sued Southwest Missouri Truck Center, Inc., ("Southwest") for breach of a contract wherein Gilomen agreed to sell, and Southwest agreed to buy, a parcel of real estate owned by Gilomen. Southwest counterclaimed against Gilomen, averring that Gilomen breached the contract.
