OPINION

DUGGAN, Justice.

Appellant was found guilty in a non-jury trial of possession of less than 28 grams of cocaine. The trial court found the enhancement allegation in the indictment to be true, and assessed punishment at five years confinement.

Appellant was indicted in Cause No. 389,267 for possession of heroin with intent to deliver. On March 1, 1984, the trial court heard and granted appellant...
