DEVICH, J.

Plaintiff, Vaughn Bruenn (Bruenn), appeals following an order granting summary judgment1 in favor of defendant, Aetna Life Insurance Company (Aetna). He contends the trial court erred in determining his action was preempted by federal law. We affirm.
