FORSBERG, Judge.

Appellant was charged with criminal sexual conduct in the first, third and fourth degree. The complaint was amended immediately prior to trial to include a charge of kidnapping. Appellant was found guilty of criminal sexual conduct in the first degree and kidnapping, and found not guilty of criminal sexual conduct in the third and fourth degree.
