OPINION

CRIPPEN, Judge.

In this custody dispute between a step-parent and a natural parent, the stepparent questions whether the trial court erred in its application of the law and its refusal to conduct an evidentiary hearing or provide for a custody evaluation. We reverse and remand for an evidentiary hearing and findings under controlling law.
