Two charges had been filed against Robert L. Hoffman. The first charge was possession of burglar's tools in violation of Neb.Rev.Stat. § 28-508(1)(a) (Reissue 1985), which is a Class IV felony punishable by a maximum sentence of 5 years' imprisonment, a $10,000 fine, or both such fine and imprisonment, with no minimum penalty.
