On February 10, 1986, the plaintiff, Eddie's Quality Oysters, Inc., filed suit on an open account against F.S.B., Inc. and Frank S. Bellavia. According to plaintiff's petition, Bellavia made payments on this account with checks which he knew his bank account did not have sufficient funds to cover.
