These actions arise out of a motorcycle accident which occurred on June 17, 1981 in the Village of Broadalbin, Fulton County. Plaintiff Daniel W. Hayes was driving his motorcycle and Victor Politi, Jr. (hereinafter Politi) was a passenger thereon.
