This case involves the question of who has standing to bring an action for employment discrimination based on "handicap" under the Commission on Human Rights Act, TEX.REV.CIV.STAT.ANN. art. 5221k. The court of appeals held that article 5221k does not require a determination of whether a person is a "handicapped person," but only a determination of whether an employer refused to hire a person "because of handicap."
