Plaintiff Wilmington Housing Authority ("WHA") instituted this diversity action against defendant Pan Builders, Inc. ("Pan"), and Pan's surety defendant Pennsylvania National Mutual Casualty Company ("PNMC") to recover $72,000 in liquidated damages for Pan's failure to timely perform two heating installation contracts for WHA.
