Steve Miller was hit by an automobile driven by George Loman, an uninsured motorist, after Miller had exited a truck owned by John C. Perkinson. Miller brought suit against Loman, Perkinson, and Perkinson's insurer, Allstate Insurance Company. Allstate filed a motion for summary judgment which the trial court granted, finding Miller's accident outside the scope of the Uninsured Motorist provision of Perkinson's policy.
