In 1982, Warren Majoue filed an action in Louisiana state court alleging that he was wrongfully discharged by his employer, New Orleans Public Service, Inc. (NOPSI). NOPSI unsuccessfully attempted to remove the action to federal district court. NOPSI now brings an action in federal court, seeking a declaration that Majoue's state claims are artfully pled claims under the Employee Retirement Income Security Act...
