BOSLAUGH, Justice.

The defendant, Floyd Warford, was convicted of first degree sexual assault on a child, a felony under Neb.Rev.Stat. § 28-319 (Reissue 1985), and sentenced to the Nebraska Penal and Correctional Complex for a term of not less than 2 nor more than 5 years. The acts complained of were alleged to have occurred on or about July 5, 1983, when the victim was 4½ years old and the defendant was 43.
