After a bench trial, defendant, Jimmie Lee Hurse, was convicted of assaulting a prison employee while lawfully imprisoned in a state prison, in violation of MCL 750.197c; MSA 28.394(3). Defendant subsequently pled guilty to a supplemental information charging him as an habitual offender, second offense, in violation of MCL 769.10; MSA 28.1082.
