James Arthur Byrd appeals his conviction for aggravated assault. On August 17, 1981, appellant entered a plea of guilty. The trial court deferred adjudication of guilt for five years under the terms of Article 42.12, section 3d(a) of the Texas Code of Criminal Procedure. Thereafter, in July 1983, the State moved to adjudicate guilt. Pursuant to this motion a hearing was held on appellant's competency to stand trial, and a jury found that appellant...
