ALMON, Justice.

Mobile County appeals from an order of the circuit court denying its petition for a writ of mandamus directing the City of Saraland to grant Mobile County a permit to install a drainage pipe across the rightof-way of Bayou Sara Avenue. We reverse and remand to the circuit court of Mobile County for that court to issue an order granting the writ of mandamus.
