Appellant Elgin Smith was charged with one count of criminal sexual conduct in the first degree, Minn.Stat. § 609.342(a) (1984), and two counts of criminal sexual conduct in the second degree, Minn.Stat. § 604.343(b) (1984). Appellant was also charged with one count of obstructing legal process and one count of disorderly conduct, which counts were dismissed by the State and are not at issue.
