Vic Landry, plaintiff, sued his former employer, Pauli's Incorporated, defendant, for $400.00 in past due wages in the form of earned vacation pay for 1984 and requested penalty wages and attorney fees pursuant to LSA-R.S. 23:631-2. Defendant reconvened alleging plaintiff had been overpaid by approximately $1,000.00 during 1983 and 1984 for days he had not worked.
