Moussa Nassar appeals from the district court's2 denial of his petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254. Appellant then filed a request for and was granted a Certificate of Probable Cause pursuant to 28 U.S.C. § 2253. Appellant proceeded in forma pauperis in this action and appeal on the writ of habeas corpus was automatically allowed.
