STARR, Circuit Judge:

This case arises out of a street brawl in downtown Washington, D.C. in August 1982. The specific question before us is whether a tavernkeeper can be held liable for the tortious conduct of its patron who becomes intoxicated on the premises. The District Court concluded that, by virtue of this court's decision in Marusa v. District of Columbia, 484 F.2d 828
