GONZALEZ, Justice.

The primary issue in this appeal is whether the court of appeals applied the correct legal standard when it ordered a remittitur of exemplary damages. John C. Tatum, Jr. sued Preston Carter Company for breach of an agency agreement and breach of fiduciary duty.
