Defendant David Hicks was charged with two counts of cruelty to children, MCL 750.136; MSA 28.331, and with being a second felony offender, MCL 769.10; MSA 28.1082. David Hicks was tried jointly with his wife, defendant Mary Hicks, who was also charged with two counts of cruelty to children.
