PEOPLE v. GAY

119 A.D.2d 767 (1986)

The People of the State of New York, Respondent, v. Joseph Gay, Appellant

Appellate Division of the Supreme Court of the State of New York, Second Department.

April 21, 1986

Judgment affirmed.

Viewing the evidence in the light most favorable to the prosecution, as we are required to do (see, e.g., People v Malizia, 62 N.Y.2d 755, 757, cert denied 469 U.S. 932), we find that the evidence established the defendant's guilt of the crime of murder in the second degree beyond a reasonable doubt (see, People v Contes, 60 N.Y.2d 620).
