MEMORANDUM ON MOTION FOR SUMMARY JUDGMENT

Before the Court is a Motion for Summary Judgment commenced by the plaintiff, Patrick A. Doucette, in an adversary proceeding brought against the defendant/debtor, Irwin Kwiat. The complaint alleges that certain debts of the defendant's, owing to the plaintiff pursuant to a judgment from the state court are non-dischargeable under 11 U.S.C. § 523(a)(4)1
