Dennis Lindberg appeals from an order of the Commissioner of the Department of Natural Resources determining the ordinary high water level of Maple Lake in Polk County and ordering Lindberg not to repair the road placed in the lake. Lindberg contends the Commissioner's determination that the ordinary high water level of Maple Lake is 1173 feet above sea level is both unsupported by substantial evidence and arbitrary.
