The sole issue upon appeal is the propriety of the district court's summary judgment in favor of the third party defendants, Sauer Industrial Contracting, Inc. and Continental Casualty Company.

Originally, plaintiff Charlotte Ann Lopez filed a wrongful death action on the basis of negligence and strict liability for the untimely demise of her husband, Don Anthony Lopez, who was asphyxiated by nitrogen gas. The plaintiff brought her suit...
