This matter is before the court on motion of defendant United Brands Company (hereinafter "United Brands") for summary judgment and on motion of defendant Empresa Hondurena De Vapores, S.A. (hereinafter "Empresa") to dismiss the complaint. United Brands and Empresa filed their motions, respectively, on December 12, 1985, and December 23, 1985.
