Judgment was entered in favor of defendant Rybar on June 26, 1985. On July 5, 1985 Hamilton filed a motion for a new trial pursuant to I.R.C.P. 59(a), which motion was denied by the trial court on September 10, 1985. On September 27, 1985 Hamilton filed a motion for reconsideration, which motion was denied on October 23, 1985.
