This action arises as the result of a one car automobile accident which occurred on April 20, 1974 at a T-shaped intersection in rural Madison Parish. Both the driver, William D. Hutson, and the passenger, Daniel E. Mize, were seriously injured. As a consequence, each instituted an action against the Madison Parish Police Jury, which filed a third party demand against the State of Louisiana through the Department of Highways (DOTD).
