Appellant Tramp Oil and Marine, Ltd. (Tramp), a broker of bunker fuel, was literally stuck in the middle of the transaction when the appellee-vessel M/V Mermaid I (Mermaid) was supplied with fuel while in the port of Savannah, Georgia. Although everyone else involved in the five-party deal received payment, Tramp was left with an unpaid balance in excess of $46,000.
