Ordered that the judgment is affirmed, and this case is remitted to the Supreme Court, Kings County, for further proceedings pursuant to CPL 460.50 (5).

At approximately 10:15 on the night of February 8, 1984, the police found Salvatore Sciortino lying unconscious on the sidewalk in a largely deserted industrial area of Brooklyn.
