EX PARTE FIVEL

No. 01-85-00736-CR.

704 S.W.2d 125 (1986)

Ex parte Ernest J. FIVEL.

Court of Appeals of Texas, Houston (1st Dist.).

Discretionary Review Refused March 19, 1986.

Attorney(s) appearing for the Case

Larry D. Dowell, Houston, for relator.

John B. Holmes, Jr., J. Harvey Hudson, John Kyles, Harris Co. Asst. Dist. Attys., Houston, for respondent.

Before EVANS, WARREN and JACK SMITH, JJ.

OPINION

JACK SMITH, Justice.

The appellant seeks review of an order of the trial court denying his petition for habeas corpus relief.

The appellant's sole contention is that the charges against him, i.e., eight counts of aggravated robbery, should be dismissed because he was not afforded a probable cause hearing within 24 hours after his arrest. He bases this argument upon Sanders v. City of Houston, 543 F.Supp. 694
