BRUNSON, Judge.

Defendant, Willie Brown, Jr. was tried before a judge and found guilty as charged of the second degree murder of one, Walter Dukes. He was sentenced to life imprisonment without benefit of probation, parole or suspension of sentence as mandated by LSA-R.S. 14:30.1. On appeal, defendant relies on two assignments of error.
