OPINION

CRIPPEN, Judge.

Appellant James Weaver was convicted of two counts of criminal sexual conduct in the first degree, one count of criminal sexual conduct in the third degree (a lesser included offense), and one count of fifth degree assault (a lesser included offense). He was also charged with second degree assault, but the charge was later dismissed. Appellant was sentenced to 43 months for one count of criminal sexual conduct in the first degree...
