The plaintiff brought this action under the Lanham Act, 15 U.S.C. §§ 1051 et seq., seeking a declaratory judgment1 that its use of the word "silk" does not infringe the defendants' registered trademark SILK.2 The plaintiff now moves for summary judgment on the question of infringement.
