Ordered that the order is modified, by deleting therefrom the provisions granting that branch of the plaintiff's cross motion which was for summary judgment on the issue of liability and setting the matter down for a trial on the issue of damages, and substituting therefor a provision denying said branch of the plaintiff's cross motion. As so modified, the order is affirmed, without costs or disbursements.
