Defendant-Appellant Russell Boyd was found guilty by a jury in the Clark Circuit Court of the crimes of burglary, murder, and felony murder. The jury subsequently recommended the death penalty for Defendant. The trial court found that the burglary and murder charges had merged into the felony murder charge and accordingly sentenced Defendant on the felony murder charge only.
