The plaintiff was injured on May 7, 1981, while operating a 60-ton metal punch press at the manufacturing plant of his employer, the third-party defendant, Livingston Industries. The machine had been manufactured and sold in 1947 by the defendants and had changed hands several times before it was purchased by the plaintiff's employer in 1971 at a sheriff's auction.
