This is an appeal from the district court for Keith County, Nebraska. The plaintiff-appellee, H. Lee Grube, brought suit against the defendants-appellants, the City of Ogallala, Nebraska, and Paul W. Fisher, the city's clerk and treasurer, seeking to have special assessments levied against his property by the defendants be declared null and void. Trial was held to the court on February 5, 1985.
