BROWN, Justice.

Appellant Steven Wayne MacLaird was found guilty of burglary by a jury and sentenced to a term in the penitentiary. On appeal he raises five issues:

"1. Can a person in custody, whose claimed personal property has been inventoried, segregated, and placed in a police evidence locker, have specific items seized without a warrant even if probable cause exists? "2. May a prosecuting attorney give his personal affirmative unsworn testimony...
