On 21 December 1982, Donald Hikes sustained injuries resulting in, among other things, the loss of a leg when the motorcycle he was riding collided with the insured vehicle of Donald and Jane White. Donald Hikes and his wife Ethelene Hikes sued the Whites, but Donald Hikes' claim was settled when the South Carolina Insurance Company (Insurance Company) paid him $25,000, the policy limits, in full settlement of his damage claim.
