Defendant Charles W. Tarver was the owner of a bar and restaurant business which was destroyed by a fire on January 13, 1983. Tarver's property insurer denied liability on his claim on the basis of arson and fraud. Tarver hired an attorney, Murdoch J. Hertzog, to represent him in an action against the insurer.
