James Joseph, a member of Calvary Baptist Church (Church), was injured while voluntarily repairing the Church roof when a ladder he was descending fell, allegedly because one of his fellow church members set up the ladder negligently. Joseph brought suit against the Church, on the theory that the Church was liable for the negligent actions of its agent. The Church moved for summary judgment, which the trial court granted.
