On September 13, 1983, plaintiff, C.P.W. Investments # 2, filed a complaint seeking reimbursement of sums that defendant, City of Troy, had allegedly unlawfully required it to pay for public road improvements as a condition to defendant's approval of plaintiff's residential subdivision plat located in defendant city.
