This case arises from ongoing litigation between the parties in both circuit and chancery court. This is the third time the parties have been before us on appeal. This appeal is from a foreclosure decree in chancery court and presents the question of whether Charlene McKenzie, the appellee, lost her right to foreclosure in chancery court when she voluntarily nonsuited the same claim in the circuit court proceeding.
