BAKER, Chief Judge.

This is an action for damages under the Federal Tort Claims Act, 28 U.S.C. § 2671 et seq. Jurisdiction is based upon 28 U.S.C. § 1346. At the close of the plaintiff's evidence, the defendant moved for dismissal pursuant to Fed.R.Civ.P. 41(b). For the reasons hereinafter stated, the motion will be allowed.
