Defendant Emerick was indicted for aggravated rape (R.S. 14:42) and two counts of aggravated crime against nature (R.S. 14:89.1). A jury found defendant guilty of each charge, and he was subsequently sentenced to life imprisonment at hard labor without benefit of parole for aggravated rape and fifteen years at hard labor on each count of aggravated crime against nature.
